    Daughter got in a traffic accident. She has no insurance.
    My daughter got in a traffic accident. She had no insurance. She told the cop she was at fault. But after going to the hospital (minor injuries) and reliving the accident she now feels she was not at fault. But the police report says everything she said. She was texting, she was driving 45 in a 40 and light was yellow upon entering intersection then turned red. Only thing going for her is that the cop sketched the accident which put her looking like it was not her fault. Shows accident almost all the way through intersection. The car that hit her is a 08 mercedes. A 17 yr old with her 15 yr old sister were in it.

    Was the other car going straight or turning left?
    Where was your daughters car hit?

    My daughter was going straight and in the fast lane and the other car was turning left and in the first lane turning left. The other driver hit my daughter.

    Also, her car was hit in the front drivers side fender - tire area. Totalled. Air bags deployed. A honda civic

    In my state the person going through the yellow light has the right of way once they get in the intersection. Any cars turning left are automatically at fault.
    Hopefully they do not put much weight on her saying it was her fault.

    Both in the wrong,

    You can not legally enter with the light is yellow, it is to give you time to get though if already in.

    You can not make a turn unless it is clear,

    Yeah it would depend on exactly where she was when the light turned yellow.
    Both in the wrong could mean
    50/50
    60/40
    80/20

    It was also the other drivers responsibility to not go into the intersection seeing she did not slow down and stop.

    The worrisome part is her lack of insurance.
