    Passport Notarization query
    HI,

    My husband is working in US on H1B visa and have the valid SSN.
    Me and My 1 year old baby are on H4 Visa.
    We came to USA in Jan 2009 and going back to India in Sep 2009.
    Let me know whether we need the passport notarization for the purpose for filling the tax return jointly from india.

    What else needs to be take care before we move back to the india for the tax purpose.

    Who are authoried agengies for the purpose of tax notarization?

    Can we get it done from Us postal office.

    I have heard they charge 5$ per page

    Okay, you CAN get the passport photocopies notarized by the USPS; not sure what, if anything, they charge for this service.

    As an alternative, you can also have it done at your local bank (unless you live in California, which has a peculiar state law which prohibits this practice). The bank will likely NOT charge you for the service, especially if your husband has an account with the bank.

    However, the safest and easiest alternative may be the IRS itself. Call your local IRS office, ask them if they provide the service to certify passport photocopes as "true copies", then make an appointment and go to the local IRS office and have it done there.

    However, if your husband arrived in January 2009, and will return to India before the end of 2009, then you and he cannot file jointly. He must file as a dual-status alien.

    He CAN claim you and your child as dependents, which is why you want to have the passport photocopies certified by the IRS. In fact, to be safe, get TWO complete copies of each passport certified so you have an extra copy to re-submit should the IRS LOSE the original submission (does not happen often, but it DOES happen).

    How we'll file the tax return from india? Do we need to send the hardcopy of all the documents or we can e-file it??

    You can not efile your tax return with Form W7 and copy of passport.
