Parent wants to leave state with child, father objects never married
My daughter had a child out of wedlock. She is now married and due to job opportunities, economy, family issues and support she wants to move with her husband and two children out of the state of Nevada. THe father's family all live in the same town she is moving to and is willing to give them visitation, as well as visitation each month for father. THe school system is at the bottom where they are and at the top where they want to move, family is there, museums, crime is much lower and many other things. Father has no job and wants full custody and child support. What are the chances she will be able to move? She and her husband are both educated, father not and not working. Lives with someone. Father does not pay child support at all. Is there anything that she should be prepared to present? Father has also had arrests on his record.

She needs to take it to family court and have the Judge write up a custody/ visitation order.
If they already have one she needs to go get it modified.

She will not be able to leave, if the father lives where she is at now.

His family is not HIM, and they have no legal visits rights only he does.

So if he is visiting the children or shows to the court he wants to, it is very unlikely she can move with the children.
