    HI,

    I am a Student on F1 Visa and doing my internship in a small company as a web developer. I live in New Jersey and Work in New York. The University I'm studying in is in NJ too.

    I have worked for 1.5 months part time, And it was a Pre-Completion OPT.

    I worked from June 15th '09 to July 31st '09... so when should I pay the tax.

    Could any one help me with which FORM should I fill for the taxes and what all taxes should I pay.

    Even I want to know what state tax should I pay New York(Where I work) or NJ(Where I live).

    I have no knowledge of taxes.

    And could you guys be kind enough to show steps how to pay the taxes online.


    I would really appreciate every help of yours

    If you did not complete 5 years on F1/OPT, for federal return you will file nonresident return Form 1040NR or 1040NR-EZ and Form 8843. Your U.S. Tax Return: U.S. Tax Filing Requirements for Non-Residents

    Since you worked in NY, for the income earned in NY, you will file NY tax return (as nonresident).
    You will also file NJ tax return and report even the income earned in NY. Then on NY return, you will claim credit for the taxes paid to NY.

    So I pay NY Taxes with Form 1040NR or 1040NR-EZ and Form 8843

    And with the same Forms ill Pay NJ Taxes too... is that correct?

    Then which form should I fill to claim my NY Taxes?

    I did not complete 5 Years of F1/OPT.

    I worked from 15th June to 31st July '09, so when should I file my returns?

    And can I use E-File https://www.freefilefillableforms.com/FFA/Gateway.htm to fill the forms and file taxes?

    Could you recommend any software which I can use.

    The credit that NJ gives you for the taxes paid to NY should COMPLETELY OFFSET any NJ tax obligation. You still need to file the NJ tax return, but you will owe NO taxes.

    You need to file tax returns for 2008 right now; they were due on 15 April 2009, but unless you owe taxes, there should be no penalty for filing late.

However, the tax return CANNOT be filed on-line. You must print and mail the forms.
