I recently filed for and is now receiving child support. I'm seeking retroactive child support going back to 2003. We go back to court on 10/29/09 regarding retroactive child support. My child's father was paying her tuition to attend private school but never contributed for food or shelter etc. Since the was paying her tuition, will this disqualify me from receiving retroactive child support and will they ask me why I'm just now requesting back child support.

Child support is usually granted from the date it was filed not necessarily the date of the child's birth (unless the custodial parent is receiving public assistance). You said you recently filed so more than likely you will not be granted any payments prior to filing... and especially not going back as far as 2003.

What will almost certainly disqualify you for retroactive support is that you never requested support. As Nikosmom said, Support is generally only granted from the date you file. Now, lets say you filed on 1/2/2009 and it took 8 months for the case to wind through the courts and an order finally granted. You could, then qualify for retro support back to 2/1/2009, but no further.

His paying tuition will probably not affect anything, especially if he was the one insisting on the private school.

These two answers are correct. Support is generally granted from the time it is filed for. 2003 is very long ago and I don't see any judge awarding that. Scott's example it what usually happens in court.
