    Brother is living in apt w/o paying rent for years.
    Hello, my siblings & I own a house in nyc. A cpl of the apts are rented & one of my brothers lives there rent free in return for taking care of the repairs when needed but does it only when he wants to & doesn't always finish the jobs. A cpl of years ago I mentioned to him that he needed to pay some rent but he got accept & just ignored it. When I moved out he was to take care of collecting the rent & pay the house bills (txs, water etc) with the rent money. He would at times tell me there wasn't enough money to pay the bills & asked me for more; unfortunately, I didn't question him & just gave him extra. When my sister & I started to suspect something was wrong we took away that responsibility; he got upset over it. My question is, how can we get him to pay back what he took from the rent w/o our consent & also pay rent? Can it be deducted from his share of the house when it is sold?

    Hello S:

    You had no written agreement with him. So, you won't win if you sued.

    But, what are you going to do in the meantime? Is he still the manager?? Is he still a RENT FREE tenant??

    If you want to DO something about THAT, ask away, and we'll tell you how.

    Hello,
    I didn't think my 'trust' in him will hold up in court. However, he's no longer collecting the rent. Although we've asked him to pay rent, he's still living rent free. How can we 'force' him to pay rent or move out. Thanks

    I'm not sure I'm understanding this entirely. Does your brother also own the house with you and your sister or not? You said you and your siblings but I can't tell if you're including him as an owner?
