There was an investigation going on against my boyfriend. Yesturday afternoon we were informed that there was not enough evidence to charge him (because he didn't commit the crime). However this morning we find out that there is still not enough evidence to charge him however there us a lady that works for some department that can not only question him she can actually accuse him and the refer that he be charged. Along with all of that she can also question any people around him that she wants. She's not a cop, lawyer, detective, judge, jailer. She's a nobody except that she works for the state. Can she really do this? Is there something that can be done?

They can only investigate the crime and until they come up with proof then it is nothing more than investigation and possibly some intimidation.

Sure she can. In this country, anybody can talk to anybody, and ask them anything they want. Of course, there's no rules or law that REQUIRES anybody to respond. But, if people want to talk, they certainly can...

If she's NOT a cop, though, the evidence she gathers most likely won't be admissible in court. And, her recommendations most likely won't be regarded. But, she can certainly tell the cops where to go look.

What department DOES she work for?

Then I take it that this involves a case with children. I would say that even though he may not be charged with any crime there is reason for CPS to believe that there is reason to believe the safety of the children should be checked into. Not knowing what the situation is I really can't come up with any ideas of why they might be investigating. If they feel he may be a threat or a serious problem to the kids then they will investigate

Children protection services is an entire different issue. Each state has its own rules or policies

1st off thank you all for your advice. And I do know the situation. However, the situation really isn't the problem here. What it comes down to is She's not a cop so Does she have the authority to accuse and question? And if she was to talk to me would I be required to answer her questions?

We don't know the situation so we can only guess.

She can question you. She can question him.
If you are the mother of these kids then she can use refusing to comply with them against you to say that you are not doing things 'in the best interest of the kids' and putting his interests above the interest of your kids

She can not charge your boyfriend with a crime because she doesn't have the authority to but she can pass on to the police any information she feels necessary to pass on to them -I do believe.
