If a person I fired on Dec 10, 2007 brings a law suit against me on December 10, 2009 and the statue of limitations is two years, then has the statue of limitations run out or has the action been commenced within the alloted two years?

I would say that he has until midnight on the 10th to file. A judge might rule differently, though.
