Single Parent trying to Regain Custody of her child
Well I signed over Guardianship of my 3 year old son about 2.5 years ago. I was having some problems taking care of him. The people that I was living with at the time were pushing for the Guardianship, so I went for it. Now I regret it. The people that are taking care of him are well rather odd. They seem to be treating him oddly. My son seems to very withdrawn and shows signs of OCD. The judge was both my parents Lawyer. He seems to be taking their side and does not wish to go any further. I have appeared before him on many occasions and he seems to be doing googlie eyes with the women and she's responding back to him. The women is showing signs of personal possession with my child. I have been to Mediation twice. The first time was a flop she got a lawyer and had it turned over then she got ride of the lawyer and now back to Pro sa. The second time I went to Mediation I got to over nights with my child and then we went back to Mediation and she did not want to go any further. This women put in a motion to start unsupervised visits and over nights and them she pulls out of Mediation. The Guardians want to move out of the state with my child and they want to get a divorce.
I would like some guidance. I'm not sure as to which direction I need to go.
Should I go for Termination of Guardianship through Mediation or Terminate Guardianship through the courts?

If you really want your child back then by all means go to court not mediation. When you did this did you terminate your parental rights? If not and your situation has changed and you now have it together go to court but get a lawyer. Try to get the judge changed and expect to spend a lot of time in the future with counselors for you and your son as this is really going to confuse him.

Well house11674, I did not terminate my parental rights. The Judge refused to remove himself form the bench. He states that he has a better insight on the case, because he defended my parents in the same case. We have tried to change venue as well, and he states that he has jurisdiction of the minor child.

Then you need to go over his head to a higher court.
