Have you been in contact with the other insurance company? Or do you mean that the other person's policy has exhausted its limits?

If you're saying that the other person's policy has paid out to its limit, then if you have coverage for Underinsured Motorists, you can use your policy to pay your medical bills up to your policy's limits. You may have a small deductible to meet (usually like $100). Do you know if you have this?

Otherwise, you may want to seek a Personal Injury attorney to sue the other person for your medical expenses.

Come back and clarify some of the details (complete sentences please).

You should have already contacted your insurance company. Check your policy ; it may include benefits for medical expenses. Document all medical expenses that you incur. It sounds like you're going to eventually have to file a personal injury lawsuit against the other driver.

One thing you need to do is start your own post. Hopefully a moderator here will separate this to its own thread.

If the other driver was at fault your auto insurance should being going after the other driver. So YES you need to report this to your insurance company so they can handle it for you. You should have notified them when the accident happened. You need to do whatever through your company, You will have to provide your insurance company with the bills you paid.

There is no such thing as "no fault" in Georgia, either you or them are at fault. ( or both partial)

If they hit you from behind and the they are at fault, their insurance should be paying all of your bills, have you filed a claim against their insurance

Hello nikosmom

I have contacted the other persons Insurance Company which is at fault. Spoke with liability adjuster which instructed me to seek medical attention through my health insurance (which I do not have) or pay out of pocket expenses up front and then they will reinburst me when its time to settle.

I will check into my auto policy to see what coverages I have and how it can assist me in this matter. I was under the impression that if the accident was the fault of someone else - their insurance is responsible for auto repairs as well as liability (medical) and my own insurance company would not be incline to get involved

Yes I have filed a claim through their Insurance Company. They are paying for my Automobile repair. They will pay for my Medical - however I have to either go through my Health Insurance (which I do not have) or pay for the Medical Expenses up front. The other persons Insurance Company claims that they will reinburst me for whatever expense I occurred once it is time to settle. Problem is I do not have any more money to continue seeing a doctor which is required.

Have you talked with your health care provider about temporarily waiving the charges until the claim is settled? Some are willing to work with you if they know you are waiting on monies from an accident settlement. That's one option.

You don't have to get your insurance company involved but for the time being, it may allow you to get the medical care that you need and then your company can seek repayment from the other person's policy. Call your insurance agent and check to see what coverages you have on your policy.

Sometimes smaller insurance companies use the reimbursement method because it often deters claimants from seeking extended medical treatment if they have to front the costs. Again, check your policy and then your insurance company's lawyers can fight to get their money back. If the other person was determined to be at fault then their policy is responsible for your injuries and car repair.
