    Evicting a guest
Last month I took my brother in to help him get on his feet. He brought his girlfriend over after he was told not to. I advised him she can't stay. He said he was moving out, when I got home they were gone but left their property so I put it outside. The police showed up at my home said because my brother has stayed in my home for more than 3 days I have to legally evict him. Is this true, he doesn't pay rent, food, utilities.

    Hello S:

It IS true, but it's already after the fact. All he can do now is sue you for an illegal eviction. The cops can't make you take him and his stuff back inside.

If my brother sues me what are the consequences?

    Hello again, s:

I looked, but couldn't find anything. California doesn't make it easy. Maybe that's why they're going broke.

My guess is it'll be maybe three months rent, or an approximation thereof because he paid no rent. I'm just guessing...

But, if he doesn't have the resources to find a place to live, he's probably going to be busy taking care of that.
