    Dual-status alien and first-time homebuyer credit
    If I elect to make the first-year choice and file as a dual-status alien for 2009 starting October 1, will I qualify for the 8000 first-time homebuyer credit? If so, will I have to purchase the house after October 1?

    You do NOT qualify for the First-Time Home Buyer's Credit. To qualify, you MUST be a resident alien.

    Are you married? If so, you can file jointly with your spouse and you both CHOOSE to be treated as resident aliens for all of 2009. If you make that choice, then (and only then) will you qualify for the $8,000 First-Time Home Buyer's Credit.
