Hi! Thanks for replying. Let me give you some background inforamation that doesn't paint a good picture of me. I've been married for a little over 2 years and we have a 2 year old daughter. I stayed home and took care of my daughter. Things just weren't going well with my husband. His best friend had been staying at the house for a while. It was wrong but I became interested with his best friend and I ended up getting pregnant by him probably. I am 21 and not very mature. So my husband and I came home from some function and he said I had to leave the house right now. No money to help me out. He wouldn't have gotten such a big IRS refund if it hadn't been for me and my daughter. So, I know I made a big mistake by getting pregnant. My husband is now running with other women bringing to our house. Considering the circumstances does he have the legal right to kick me out of the house? :(
It would help to know what state you live in to determine what your rights are. But you do have rights and he can't summarily kick you out.
You need to file for divorce IMMEDIATELY. You can also get the police to accompany you back to the house and have them tell him he can't just kick you out. But frankly I wouldn't try to force my back. What I would do is get all your belongings and take them with you.
Then serve him with divorce papers asking for joint custody of your daughter spousal support, etc.
And unless you want him to always keep the child, you need to get the child back, so the child lives at mom with you. But you file for divorce, file for custody and file for child support
