    My husband want to adopt my child
    Hi I have a 5 year old daughter her father is not in her life(well he only call her once a month, he don't do anything for her,his name is not on the birth paper and my husband want to adopt her and change her last name to his name,
    Can he adopt her with out going to court , or do we need to take her father to court first?

    You need to get the biological father to relinquish his rights IN COURT before you can even start with adoption proceedings.

    The fact that he's not on the birth certificate only means that you have MORE steps to do--namely, establishing that he IS the biological father, usually through DNA.

    If he will not do so willingly, and you can not prove that he's a danger to the child, then you're out of luck.

    Hi my daughter have my last name so what if I wanted her to have my husband name do I still have to go thought court to do that or do I or her father need to been in court

    For a name change, generally BOTH legal parents need to consent to it.

    You really need to talk to a lawyer in your area to find out what your local laws are on it.

    Sometimes you say he's your husband. Sometimes you say he's your boyfriend. At any rate, he's legally married to someone else.

    He cannot adopt your child.
