Hello,

I am currently on probation in Michigan for first time drug offenses. Although my charges
Were of the felony level, I ended up with the holmes youthful trainee act; which means I have 1.5 years of probation and community service. Upon completion nothing is left on my record. I am on reporting probation, and I have to report every two months. I am on low watch and have not been contacted by my PO and the one report I went to I was not drug tested.

I've request moving two hours away to attend Eastern Michigan University, as I just finished my associates at Community College. My PO seems to think that it should go smooth, but the county down there has a right to deny me.

My question is if they will/can deny me? Are there steps I can take if they do? I have a job and school all lined up, a lease signed to move into a nice area of town, and them not allowing me to move would be giant kick in the nuts. My community service will also be done by the time I apply to move.

No one knows what "they" will do - I'm a little surprised that you signed a lease before you got permission to move.

Have you read the "sticky" in this thread - at the top - about tranferring probation?

Yes, and I am going through that process. I am just wondering what the probable outcome is going to be. I didn't really have much of a choice with the lease.

Unfortunately none of us are mindreaders and so it's impossible to know.

You can prepare as well as you can, cross the "t's," dot the "i's," and then hope for the best.

It does sound like you've made big, important changes in your life and I hope it works out for you.

Well, I'm just curious as to if I have everything lined up... can they say no? I mean, if they do not allow me to do this then I would lose an education, a job, and a residence. The fact that I'm on low watch and only report once every two months makes me think that I won't be too big of a burden on a new county, so I'm just hoping they keep my best interest in mind when making the decision.

You just never know what the Court system will do - if there is a feeling that you put all of this into motion before you got a decision, perhaps (and I'm NOT saying this WAS your intention) to force a decision favorable to you, it will go against you.

You just don't know. We have all seen some very strange decisions/rulings, some that don't seem to benefit anyone, not the individual, not the general public.

I don't believe they can. If you've read what I wrote, you HAVE the policy... The policy should be a STATEWIDE policy, rather than a COUNTY policy. It will tell you if they have that ability or not... Of course, your PO will tell you they do, but you shouldn't believe them.

Did you, as I recommend, VISIT the PO in the new county?? If you did, and all you want to do is go to school to better yourself, then they won't deny you. But, if you didn't, and they can say no, WHY would they say yes?? What?? They NEED another felon in their county?? I don't think they do, and I think that's the way they'll think too.
