Here is the question my live in girlfriend for 14 year's is not divorced but leagly separated, she has lived with me the whole time we now have a five year old son and a two year old daughter the hospital would not let me give either one my surname they said by tenn. State law they had to take her married name now my son is going to go to school with another man's last name me and her have been to the court house and the health department and they can't or won't tell us anything please help!! I won't them to have my last name!

Are you on the birth certificate ? Are you the legal father in any way ?

If the answer is no then you need to go to court and right things. As it is they may be HIS children and not yours by law. Why didn't she divorce him yet ?
