I know a mom that is smoking marijuana but not around her child. She says her soon to be ex husband is saying he will take her child away from her because of that. Her soon to be ex husband is on parole, he quite paying child support, he lives with someone that smokes marijuana, he doesn't have a job. She took a hair folicle drug test for him and she passed. Now he's saying that she's an unfit mom and she's not. I'm hopingi can help her with some answers do you have any answers for her?

What is she doing that he is claiming makes her unfit ?

Personally I question the fitness of both parents ; the father more so than the mother based on what you've said here. But legally the father has no leg to stand on in trying to deny the mother her parental rights. And she has no leg to stand on in trying to deny him his (if that's her intention.) The court will deal with his failure to pay his child support and his being unemployed won't be an excuse ; the judge will simply tell him to get a job. That's probably a condition of his parole anyhow.
