    Loan contingent on employment?

    I got a personal loan with a hospital and the contract stated that in the event of being fired, or quiting I would have to pay the money back in full. Well when I got of Lpn school the company did not hire me even though this is what was stated in the contract and now 4 years later when I appy for a job they want me to pay the money back even though they are finally giving me a job. I feel as though my working there is paying back the money owed. Am I totally wrong.

    I would like to know the exact language of the contract.

    If the contract stated that the hospital would employ you upon graduation (and licensing) and under those circumstances you would not need to pay the money back and is silent (doesn't mention) if they DON'T hire you, I think you have a legal defense.

    I'm a little confused why you didn't get hired in the first place - you say "4 years later when you apply for a job ...." Do you mean a job at that hospital or a job at another hospital?

    In many States non-compete agreements (you won't work for a competitor) are not legally enforceable because you cannot make people unemployed; I would think that what the hospital is saying takes this one step farther. On my initial reading it seems that they didn't hire you but they don't want you working anyplace else.

    Have I got it right?

    First its not a good idea to piggyback your question on someone else's. This can lead to confusion. You should start a new thread. So I've moved your question to its own thread.

    I agree with Judy, the situation is a bit confusing. But you need to read the contract and exactly what it says.

    If the contract stated you would be hired when you complete school, then you have a breach of contract case against them.
