    Family petition followed by green card abondened
    BACKGROUD
    There are two petition filed on behalf of one chief beneficiery under two different category in F3 and F4 family base petition.

    -> chief beneficiary has two children
    So total three derivatives

    F4 category petition

    At the time of visa interview chief beneficiary and one derivatives(spouse) got immigrant visa and two derivatives (two children )did not get visa just due to "age out"(above 21 year)

    F3 category petition

    F3 category petition has:
    Priority date 21 dec 2002
    Approved date 11 march 2005
    As this file has got child state protection act cover.
    CSPA SEP 2002.

    As both (chief beneficiary and one derivatives) has visited USA and got green card.

    Now as both of us are well established in India and has no plan to settle down in USA in near future, we wish to surrender green card.

    But, we have one doubt in my mind is that if we surrender green card and in future if we wish to settle in USA then what?

    I want to ask that after surrendering green card, As I have one approved pending petition with F3 category when VISA number is available with this petition and I got visa interview call at that time
    Am I eligible to get immigrant visa with all of my derivatives (spouse+two children above 21 year unmarried with benefit of child status protection act- sep 2002)

    If do not intend to live in the US permanently, you should relinquish your permanent residence, you can have the same petitioners file for you again.
