I live in Texas and have 6 year old daughter who paternity was never established on. The father chose a life of drugs and has not seen her in 3 1/2 years. Can I terminate any rights if paternity was never established? Or should I just leave it alone? I just fear that if something were to happen to me he could come out of the woodwork.

I take it you are saying that you never had his name on the birth certificate and you are worried that someday he could request a paternity test. I really don't think you can do anything to prevent what you are concerned about without first establishing paternity,
