I own my home and my older brother feels like he can tell me when he will pay and what he will pay me. He brings he girlfriends laundry over and washes them. He also eats the food that I buy. I want him out. So he has not paid me anything for the last couple of months and decides that this month of July he will pay me $50 short on the first half of the agreed amount of rent. I said no so he said I guess I will move. I said fine. But he tells me I have to wait for him to save up enough. Which can take months. I know I have to evict. I gave him one notice he tore it up. I will give him another and take a photo of it on his bedroom door. I am giving him a 3 day or quit. I am thinking that after the 3 days I go and file with the court correct? Then they give me a court date? Then what happens after that? There is no lease, rental agreement or anything between us. I don't know if he would show up and argue anything with the judge. He is not pleasant to live with, he is prone to stealing things and pawning them so I really don't want him in the house period. He has a criminal record for drugs and forging checks and stuff so when you are on his bad side, it is not good to have him around you.
