Hi,

Ive been charged with Section 5 public order offence 'use threatening words/behaviour to cause harassment, alarm or distress' I was basically drunk in a pub and the police were called as I was being verbally abusive

I do have 2 previous convictions for similar more serious offences, the first resulted in community service and the second in a suspended sentence from August 08 - August 09 so I am still under the suspended sentence.

I have looked at the sentencing guidelines for this offence and it seems to be punishable by way of a fine so will the fact that I am under suspended sentence make a difference in this case? Can my suspended sentence be lifted resulting in me going to prison? Or as this offence is punishable by a fine will that be classed as a different scale (if you know what I mean)
