In the US
1. there is no law on dating
2. there are laws on having sex.

If you were to have sex, that would be rape and he would go to jail.

Most Western countries don't have laws related to dating, but they do in relation to underage sexual relations.

In Australia, it's against the law for girls under 16 to have sex with guys 16 and over.

This issue has been discussed many times on this site. As noted, there are no laws governing dating. But you are under the age of consent so it would, most likely, be illegal to engage in ANY sexual activity.

At 13 you are a bit young to start dating. I can see hanging out in groups, But I would wait until, at least 14, to start one on one dating. Also a 3 yr gap at your ages, is about the limit. At your ages, you are at different levels of maturity.

Have you discussed this with your parents? Have they given you permission to "date"?

Unless of course this is my grand daughter in which case she has to wait till she is 30 or something

But seriously, as in my grand daughter she recently had her first school dance, she is 12. So she "meet" some boy at the dance, and then came home. To her that was a date, so what one means by dating is another issue

Legality starts with the parents, and that's who has the final say.

I dated when I was 13 , but it was nothing serious just guys the same age as me . So a 16 year old guy would maybe want a bit more than just a hug or a kiss on the cheek . Maybe talk it through with your parents ?

Date, yes. But taking it to levels of sexual intimacy can be risky. Each state/province has its own laws regarding minimum age and age differences. Of course, not to mention all of the other possible consequences which are far more traumatic and lasting than a brush with the law, such as unwanted pregnancy, STDs, etc.
