My kids went to visit there dad in another state for a month what I didn't know is that he plans on keeping them all summer and did not buy them a return ticket home and now told my daughter that he is going to keep them until I am more financially stable.. I am working and am afraid for my children's safety because my daughter told me that he threatened to hit her after I confronted him to the fact that he was pressuring them to stay with him.. He did this in front of her friend.. We divorced because of abuse and he does have a record of abuse w/me and I do have full physical custody.. Joint legal.. I moved out of state 8 mo ago and now he is throwing up the fact that I wasn't suppose to leave the state even though he said it was OK and child support was informed.. My daughter 7 yrs ago accused him of touching her but then was afraid he would go to jail and wouldn't talk to detectives and it was dropped.. to this day she says he did it... He lives in MN and I live in SC.. He plans on taking them to NY in a few weeks where Im afraid he will keep them since he threated to do so before our divorce... I believe this is all to stop paying childsupport because he threatened to take me to court to stop paying while he had the children... because he said he was broke.. I want my kids back!! And am afraid for there safety!! Please help!!

Go to court and file a complaint for violation of the court order and to order him to return the child

Start with the court as previous post suggested. If he ignores the order, or fails to produce, THEN it falls under the kidnapping statute.

What agreement is in place that they were sent there for a month and when will or has that month expired ?
