    Step parent adoption
    I have a question regarding my husband to adopt my 5 yr old son which we have been together since I was 4 months pregnant with him. My sons biological father has never been around and has stated he doesn't want anything to do with him. He wants to volunteerly sign his own rights away. I was wondering if I was able to file for all the papers myself. I was told I could print off papers and take them to the court myself. Since his biological father doesn't want him and my husband "his only daddy that he has ever known" does how easy and inexpensive can this be.

    I would not recommend it. You don't want to make any mistake with an adoption so its much better to have an attorney prepare everything.

    However, your local Family Court may be more flexible. So talk to the court clerk and see what the process is.

    As long as the bio fasther is willing to relinquish, the court will approve, but you want to make sure the paperwork is prepared properly.

    It is possible but not recommended. Even with all of my legal knowledge I am working on a custody issue and still hire an attorney to work as a paralegal for me doing all the paper work.

    You will have to have the bio father sign over his rights and so on. One mistake and the adoption could be latter contested.

    I know that "get a lawyer for adoption" is the standard quote here, but our lawyer (family law specialist) here in Florida actually TOLD us that an uncontested step parent adoption is so easy here that it is wasting our money getting her involved.

    We're going to have her do it anyway...
