    Can my boyfrind adopt my son?
    The father of my son has not had any contact with me or my son since I was three months pregnant. My current boyfriend was there for the birth and is still here supporting us. We are both desprite to be a family. The biological father has not paid any money at all for my son. There was an issuse with social services as they said that (father) is to have no contact with us what so ever with lewis (son). Is it possible for my boyfriend to adopt my son without the fathers concent? If so can can I get things started.

    He can after you are married and the bio father consents.

    The only way that most courts will take away a parent's rights involuntarily is if the parent is a danger to the child.

    Is the biological parent a DANGER to the child? Could you prove it in court?

    Bottom line is this: You need a lawyer.

    Does the biological father have a child support order on him? Have you had it enforced?

    Your boyfriend will not be able to adopt until you are married. The birth father will have to give his consent as well. A child support order enforcement usually convinces deadbeats to consent.

    First, please pay more attention to posting instructions. This was moved from the Adoption forum where there is a sticky that directs you to post legal questions here.

    It is extremely difficult to have an adoption approved without the bio father's consent.

    The way you get things started is by consulting an attorney familiar with Family Law. The attorney will tell you whether you and your boy friend need to be married first and for how long. They will tell you what steps you can take to terminate the bio father rights or to inspire him to relinquish them. As noted, many fathers will relinquish because an adoption removes their responsibility for support.

    All adoptions require a lawyer to draw up the papers. Therefore, your first step is to find a family law lawyer in your area. They will tell you the requirements in your state as far as what it takes for a person to even be qualified to adopt such as if you have to be married (a lot of states require this for at least one year) and how long you have to be in a stable relationship and so forth. Then once you and your boyfriend meet all of those criteria you can ask the bio father if he will allow the adoption because that would be easier than trying to have his rights removed. If he won't then you try to prove to a judge why it would be better for the child to be adopted and to have the bio fathers rights terminated.
