    Child support in another state
    I just received notice after 12yrs that I am due in to court in another state. I am the custodial parent. The non-custodial parent has put the request in. How convient. How could this happen. He hasn't paid a dime since she was born. How can I get out of this? I don't have the money resources to be in the state of IL. Let alone a hotel stay! Also, he owes quit a bit of rental property, how can I put a lien on this property?
    Thks to anyone who can answer these 2 questions.

    You need to respond that this is filed out of the child's residential jurisdiction. If you are the custodial parent and the child is residing with you and has been, then he has not filed in the correct jurisdiction. Speak with an attorney about responding. Whatever the motion is, it will be thrown out if it is filed incorrectly and you prove that... to the best of my knowledge.

    What was filed ? Visitation ? Or child support modification ?

    Before we can answer you need to specify what he filed. Do you have a support order in place? If so, why haven't you pursued it?

    1. where was the original court order filed ? ( or even is there a original court order)

    2. if the original court order was filed in the state where the bio father lives, and you moved out of state at some time, then the original state still is where the court work would be done.

    And yes you will have to go back there for court or most likely he will merely win by default.

    If there is a court order for support, then you needed to be fighting and using child support enforcement long before now.
