    Judgement imposed on credit card debt (Florida)
    My credit card (discover) was turned over to a law firm. I missed the initial hearing date, an error on my part, had the day transposed. Requested another hearing date, the judge denied another hearing date & has declared a final summary judgement. I've just received request for a fact information sheet (requesting income, ssn#, bank account statements, vehicle info etc.). However, it does not request all the other expenses I owe (insurance-home, health, vehicle, utilities, other credit card payments, etc). It even requests the names & address of children not living with me?

    Will they be able to just withdraw on my bank account or worse yet my retirement account? Will they come and take my car?

    Why would they need the name & address info of my children not living with me? I do not want them involved in this problem.

    You might be able to call and set up a payment arrangement and avoid any liens or garnishments.

    They cannot take your vehicle or your home. They can place a lien against them, but they cannot take them.

    They want contact information on your children so in the incident that you decide to stop talking to them or skip town, they can go down the list to find you.

    Your best bet would be to try and arrange a payment plan that is beneficial to both of you - not too much out of your paycheck but enough to keep them satisfied. Make sure you stick with the payments because if you don't, they won't give you another chance.

    Hello susan:

    YES, YES and no. Your car is safe. I wouldn't tell 'em my kids names either.

    IF they'll set up a payment plan with you now, that would be good. However, as I indicated, in very short order, they'll be able to just romp through your accounts and take what they wish - which will probably be ALL the dough. They'll garnish your wages too.

    IF, however, you can somehow borrow some cash, I'll bet you can negotiate a settlement for far LESS than what the judgment is for.

    Incorrect - Judgments are not reversed. Debts are considered satisfied by virtue of bankruptcy but the Judgment (which, admittedly, pales in comparison to the Bankruptcy filing) remains on a credit report.
