Chapter 802 of the WI statutes answer form.
We were just served with papers for foreclosure of our home. It states that we have 45 days in which we have to respond to it, and that the answers must follow the requirements of the statutes. We can't afford an attorney so I hope you can help me with how I need to write this. I already know that a copy has to be delivered or mailed to the court and a copy to the lawyer that is handling the case But if there a form I can follow? Please help.

Well what defense are you going to use to show why it should ot be foreclosed?

Have you paid the monthly payments and they are wrong ?

Is there some law suit you have done against the lender that has a bearing.

Is there a plan in place to not only start paying each month but to catch up all the arrears that the court may accept?

I guess the issue I see, it is great to respond, but respond how,
Not as much the foremat as to the content

We submitted all of the required paperwork to our mortgage company on March 2, 2009.
To try for a restructure. I have been keeping in phone contact about every 2 to 3 weeks to find out where they were at on it. My husband owns his own business and amputated 2 of his fingers reducing the amount of our income for a few months. That was the reason for needing this done. Every time I contacted the mortgage company I was told they had gotten the paperwork but had not done anything with it as of that time. Until then end of April. At the end of April I was told that since they had not looked at our case before April 1st that now they had to also take a look at if the new Obama plan would effect us. The next time I talked to them, I was told they needed some additional paperwork, because some of the paperwork must have gotten lost. I had been telling them all along that I would be able to begin making my mortgage payments again in July. Then early June I was told that we were denied because they were missing a profit loss. I explained that it was included with our taxes. I was then told that since so much time had passed I should just refile all of the necessary paperwork & forms so everything was updated. The same day I did that we were served with foreclosure papers. I talked to the mortgage company and they said that the foreclosure would be postponed for the next 4 months as long as I made my agreed payments starting in July. But I still have to take care of the papers we were served. Now I just want to make sure that I send the correct form and answers correctly. Now do you have any good advice & answers to help me out?
