I just moved into an apartment and now they want to talk to my old landlord? His phone # isn't on the old lease and they asked if I had it... My old landlord evicted me because I couldn't pay and my neighbors saw him creeping around and even tried to come in when he thought I wasn't home... but my daughter was... scarey... she is 14... can they kick me out if they find out I was evicted from my last place and why are they asking now... isnt that something they should have done before I moved in? Also I don't want my old landlord to know where I live now so he can harrass me or my kids... freaked out

NO, most states, have tenant rights, that prevent these type of situations, if you are paying rent now, and have not broken your lease agreement, then you have nothing to worry about, it was the new landlords responsibility to investigate your prior tenant historey and not yours, you are not responsible to give them any information that may incriminate yourself.

Did you have to fill out an application for your current aparttment? Did that application ask why you were moving? Did the application list your previous address?

The point being that if you falsified any information during the process of securing the new apartment, they might be able to use that as grounds for terminating your lease.

If you listed your old address and they failed to check, that is their problem, though. Also, were you actually evicted (by a court order) or did you just get a vacate notice from the landlord?

Yes I filled out an app... no it didn't ask why I was moving... Yes there was an eviction notice it was the same date my lease expired... So basically I should do nothing... I don't want them to give out info to him where I live now... He preys upon single moms... the next one moving in is a stripper single mom... He told me that! What a pig! Thanks again

You say an "eviction notice", but I have a feeling it wasn't. The first step in an eviction is a notice from the landlord that terminating the lease and giving you a date to vacate. This notice is not an eviction order. An eviction can only be ordered by a court and only after a hearing. Also an eviction would be on your record.

So, if they press you, tell them that you moved because the landlord creeped you out and you do not want him to know where you moved to. If you did not have a court ordered eviction, you have no worries.

What WASN'T mentioned here is your present rental agreement. IF it's a LEASE, as noted, he can't violate it.. But, if it's a month to month agreement, he can have you out in 30 days for NO reason whatsoever.
