I have a Judgement against me and I also am in contempt of court for not giving a deposition. The Judge has set a date of June 30, 2009 to either give the deposition or going to jail. My question is if I pay the Judgment before June 30, 2009 without giving a deposition does the contempt of court go away?

Generally it will become a moot point. The deposition won't be need is the judgement is satisfied.

Scott is correct BUT, it is still up to the judge, who may order it before he will close or show the judgement satisfied

If the Judgment is satisfied the Judge can still order me to take the deposition? Am I understanding you correctly?

Judges can do funny things. If you can pay the judgement to avoid giving the deposition or a contempt charge it would appear you were willfully avoiding paying. So a judge may throw the book at you. But I believe it would be overturned on appeal.

Actually I am borrowing the money and I will be able to show that. I can't afford to take off a day of work to give a deposition so since I have a friend who can help me out I might as well just pay it.

Like I said, if the judgement is satisfed, the issue of the deposition becomes moot. If you can show the judge that you are borrowing the money they should just dismiss the contempt charge.
