    You have the same rights as an American. Nationality is irrelevant.

    It would be helpful to know where the child lives and with whom.

    How long have you and your son lived in Canada? If it is long enough to claim residency then yes, start your court case there. You can get a lawyer to help you prepare your case because he/she will know what of your evidence you can and can't use and make everything easier.

    If you have lived in Canada long enough to establish residency there, that is where you file.

    If your ex wants to challenge which court should here it, then that is another hearing for the court

    If you live with the child in Canada you should file your court case in Canada, in your locality. Yes (and I'm assuming you've lived in Canada with the child for a least the last 6 months-- if not, let me know because the answer might be different).
