Does a renter have any right if a house is going into foreclosure
I currently live in a home that I am renting and the owner just put the house up for sale {short sale} without any notice well with a little investigating I found out he is behind in mortgage payments of close to $4,000 and have heard he has lost a previous house. Well me and my family are still in the home as there is a for sale sign in our front yard. We have questioned him and asked is the house going into foreclosure he says no but I know he is lying. Do I have any rights that can help me I think he is taking my monthly rent and keeping it why else would he be so behind. Finding another place to rent quickly with five kids is hard to do when you are still paying 900 to the owner everymonth and I am low income any insight someone could give me would be great I don't want to end up on the streets with my kids.

At the top of the Real Estate Law forum there is a sticky post about what tenants can/should do when a foreclosure has begun. You can read it at https://www.askmehelpdesk.com/real-e...re-316199.html

Under new Federal Law (since May) you have to be given 90 days after the foreclosure before you have to vacate.

Until a foreclosure is finalized, you have to abide by the lease.

Unless you live in California, there you do not have to pay your rent while they are in foreclosure.

Everywhere else you have to keep paying rent ( what he does with his money is not your business really)
You legally owe him the rent and can be evicted if you don't.

If you think finding a rental is hard, try to find one with an eviction on your record.

If the house sales, they will have to honor the lease

Chuck, what do you base this on? ScottGem and I have searched like crazy and found nothing that backs this up. Please let us know so that I can make any necessary corrections to the sticky post.

Working on finding it online, it was mentioned on the Clark Howard Radio show a few months ago.
