You will have to adopt the child which usually means marrying the mother and getting the bio father to relinquish his rights.
Agreed, you will have to adopt the child. The real bio father will have to give up his rights.
So the answer to your actual (non)question is that you cannot be the legal father at birth. Shortly after that is possible.

I know many guys that did not father a baby that have signed the birth certificate at birth knowingly or unknowingly. I don't know how ethical or legal that is but you could check into that. (I know it is NOT ethical to have the guy sign the birth certificate thinking he is the father)

Yeah I figured it may be perjury therefore not legal and really not a good idea wasn't really positive though.
