    Executor refuses to pay out money to heirs
    My mother had a trust and the nine children were listed as heirs. The executor of the trust has not given any money to 4 heirs following the sale of the farm. The farm was sold in March of 08. I have the understanding that he has received monies from the farm sale. The siblings are split and it is my understanding that he does not intend to give any monies to 4 of the heirs. We signed the deed to the farm with the expectations that the money be divided evenly among all the heirs. Is there any recourse for the 4 heirs left out.

    A trust is different from a will. With a will you could file a complaint with the probate court that the executor is not doing what they are responsible for.

    In a trust however, you have to sue the trustee for an accounting of the trust assets. Then sue if the accounting shows they have not distributed the trust according to its terms.

    In either case, I strongly suggest you get an attorney to do this for you.

    That's interesting. Why was it necessary that you sign the deed?
