My fiancé and I have been together ever since my daughter was 7 months old and I 2 now! Her sperm donor never went and took a paternaty test and hasn't seen her since she was 3 months old!! Can my fiancé adopt her without the sperm donors consent?:confused:

You don't need his consent. Once you're married, the court will grant his adoption or not.

Sorry Ex, but this is absolutely false. His consent is absolutely necessary. Paternity will have to be established in order for an adoption to go through. Just because he is absent does not take his rights away.Quote:

Even though her sperm donor has been in and out of jail his entire adult life, never made and effort to see her, was drunk off his A@# when he did see her, and failed to pay child support on a regular basis. The court still would not take his rights away involuntarily. We had to go as far as waiving the $9000.00 dollars that he owed in back child support to get him to voluntarily consent to giving up his rights. Then and only then was I able to adopt her. She is now my daughter, and everything is taking care of, but it is a long and gruling process. And you definently need a lawyer who specializes in family law to hear your situation before anything can happen.
A sperm donor donates through a medical agency.
A BIOLOGICAL FATHER donates through the sex you had with him.
It's offensive that people distance themselves from the fact that at one time, they liked the supposed "sperm donor" or "egg donor" enough to have sex with that person, but now that they aren't "good enough" anymore, they get relegated to a medical procedure.
YES you need his permission. Just as he would need YOUR permission, as the "egg donor" to visit with his daughter if he didn't take you to court for visitation.
So... get a lawyer. Locate the biological father. Ask him to voluntarily give up rights. If he won't do so, then you go after him for child support and hit him hard. Then you have your lawyer mention that if he allows the adoption to go through, he gets out of child support. If THAT doesn't work, and you can't prove that he's a danger to the child, then you won't be able to have your new husband adopt, because generally a court won't sever rights involuntarily unless the parent is a danger to their child.
Sperm donor is also a negative term to describe a low life, dead beat Dad. At least in normal peoples terms. Lets cut the political correctness and be realistic

I'm taking offense and trying to get people to realize that to those in the adoption community, that is an offensive term.
If she slept with him outside of marriage and got knocked up, he's no more a sperm donor than she is a whore.
