My "wife" and I are still legaly married even though she cheated on me moved out into her new mans house and even took my son. Now because we re not divorced is her being with this new boyfreind, and I do have plenty of proof regarding their living status is this adultry and can I counter file divorce with these grounds. Also she is slowly taking away my rights to my son and using the fact that she hasn't hit me for child support as a scare tactic to try and keep me quiet. I help when I can and as much as I can, I recently moved out of state to a better job so I could help out with my son. I just need to know do I have any rights in this country cause it feels like I don't anymore.

You have every right you exercise. Your dodging of child support is you giving your rights away - which, by the way, is no excuse for not supporting your child.

As for the adultery... no such thing anymore. You don't counter file for divorce. You just get divorced. Adultery does not give you the upper hand, does not make your case special and won't even be allowed to be discussed in court.

"grounds" for divorce, most states don't require any grounds, a few do.
Ga for example you can merely just file and you don't need to prove anything unless you are using it to fight for child custody or something.

First step and it should have been done long ago, hire an attorney and file for divorce. Most likely no need to prove anything
