I am currently Power of Attorney for an ex-boyfriend who is currently incarcerated. He owns his home that is going into foreclosure however he has a contract with Assist2Sell. My boyfriend decided to end his contract with Assist2Sell due to a conflict of interest being the agent was promoting illegal tenancy by allow his son to live in the now vacant home. I sent a letter to the bank at the request of my ex boyfriend letting them know he did not want Assist2Sell to sell his home and Deed in Lieu paperwork has been filled out and sent to the bank by my ex-boyfriend. I have now received paperwork from Assist @sell stating since my ex-boyfriend is incarcerated and I am Power of Attorney I am impeding the sale of this home and will be held liable. My question is can I be held liable and why? Thank you for your time.

NO! What does the contract say? You may prevent being being scammed by Assist2sell if they were selling it to one of their own companies for a deflated price. The bank can still sell it at forecloser proceedings so you need to learn a lot more in a short time.

If they can prove that you unduly influenced your boyfriend to cancel the contract without due cause, then yes, they can sue for impeding the contract. But it would be very hard to prove that.

Also how did you send the letter, you never send the letter "from you" you send it under the boyfriends name, and sign for him , making a note of you sign as POS/ You don't send the letter like it is from you, since you are not doing it.
