    I'm being evicted.
    I received a 7 day leave the premises notice on May 2, 2009 On May 28 I received a clerk of courts paper saying I was guilty of forcibly keeping the apartment and was given a date of June 4, 2009 to vacate. This is Kentucky and I was wondering if I have a right to be at court because we were not given a court date. This is for non payment, can they evict us without our having the right to go to court?

    No, they can't. Go to the court where the notice is from and tell them you never were served.

    I'm not sure - from reading the Kentucky site - that the landlord needs to schedule a hearing. It would appear (again, I'm not in Kentucky and only know what I just read) that your response should have been to the 7 day notice.

    Do you owe rent? It would appear that under that condition you simply get the 7 day notice and if you don't respond, you are evicted, sort of automatically.
