Ok, same question kind of... but different circumstances. My Fiancé is in Jail on Federal charges. Jail, not prison. She goes to court on July 10th for her sentencing. She is trying to transfer her probation and go to Halfway in NY where I am. Her mother called the probation office and they said that all transfers have to be done through her unit team. She does not have a unit team because she is only in Jail and not prison. She may not go to prison, she has done 2 years in county jails and her lawyer (who is very unreliable and hard to depend on) seems to think that with reductions she may be released later this year without going to prison. I guess my question is how do we, or how does she go about arranging a transfer without a "unit team" or a dependable lawyer ? Supposidly a transfer on Federal probation is a lot easier that State but we don't know who to contact or how to get the ball rolliong so when she is released everythhing is set. What if they release her on her court date July 10th and assign her to go to Halfway down there? Any advise and POSITIVE knowledge would be greatly appreciated.

SOMEBODY, whether it be her "unit team", or a person in jail, works for the probation department and is in charge of her case. YOU need to find that person. Yes, it may take a few phone calls.

I was a probation officer in Maryland for 7 years and can guarantee you that probation cannot be transferred until a person gets out of jail and is released on probation.

If the person is granted probation after a certain period of incarceration, it is going to be conducted where the person is going to live, and it will be supervised by a PO in that area. There will be no need to transfer the probation if it is set up that way.

As soon as the person is released, they will be given specific instructions as to who to report to and this person will be responsible for all that stuff. When the person walks out of the jailhouse door, they will have a probation order in their hand telling them exactly what they are supposed to do and where they are supposed to report. That office will set up the probation where it should be.

I don't think JimGunther and I disagree. The key phrase is "transfer"...

The probation cannot be transferred until it has been established. If she establishes her probation in NY, then there will be no need to transfer. If she establishes it where she was convicted or some other place, she'll need to transfer it.

What I'm suggesting is that there is a person in charge who can make sure that her probation is established/started in NY. That way she won't have to TRANSFER at all.
