Hi I have questions and I don't know where to get answers here's the story my husbands dad brought him here when he was 14 almost 15 and he stayed he practically grew up here, any ways we have been together 4 years and we have a 2 year old, I started fixing his papres in 2007 after we got married in 2008 he went back to mexico because we were scared he woulfd get in trouble for being here we wanted to do everything right anyway we have the interview next month in mexico I am scared that they will deny it because he was here illegally I have been without him for a year, he has missed out so much, without us, what do you think? Do you think they will deny it? He has never been in trouble here no record! Should I be at the interview with him? What proof should I take? I don't know what to do! Please help so I can at least think clearly and be positive

How did he enter the US? visa and overstay? Misrepresentation, false documents, EWI? Did anyone file anything form him before April 30, 2001? How old was he when he left the US?

It seems as if the IV issuance will require a waiver for the unlawful presence. You will need to show the hardship to you if he is denied the IV, you should show more than the financial hardship. Any medical issues with you or the child? You may want to get an assessment from a social worker, therapist or psychologist to support your position. You should also get a police clearance and if possible FBI FP check.

I advise consulting with an experienced immigration attorney to review your case. You may be able to avoid significant delays if you have the waiver and supporting documents ready at the time of the IV interview.

His dad brought him here to the US when he was 14illegaly his dad wanted him to work and go to school just to have a better life, he grew here, he has been here for 8 years, we got married in 2007, we started fixing his paperwork also in 2007 after our baby was born in 2008 February he went back to Mexico, because he thought he would get into problems if he was here and fixing his paperwork anyway a year passes and I finally receive the appointment letter to go to ciudad juarez, and I am scared they want let him come with me. I have 5 hardship letters, from government offices, ands etc. so what do you think do you think that he will be able to get the visa? Or do you think tey will deny it? I mean he has been in Mexico for the past year, I think that's enough punishment, evn for his son, it has been really hard for me. I am going to the interview also, just to see my husband and support him, do you know of any kind of other proof that will help me, this means so much to me. It has been hard because I have had 2 surgeries this last month. Please lead me into guidance thank you for answering why question.

I would agree with DCcityboy here, you really need to consider going to an immigration attorney. But him taking the right steps (going back to Mexico and applying properly from outseide the country) combined with the fact that his parents took him to the US illegally as a minor all work for him.

I agree with Lowtax4eva. Both of these are good to show "gpood faith" in immigration compliance. Please note you need to show hardship other than financial. Your medical condition could be very important.
