it seems as if the IV issuance will require a waiver for the unlawful presence. you will need to show the hardship to you if he is denied the IV, you should show more than the financial hardship. Any medical issues with you or the child? you may want to get an assessment from a social worker, therapist or psychologist to support your position. you should also get a police clearance and if possible FBI FP check.
i advise consulting with an experienced immigration attorney to review your case. you may be able to avoid significant delays if you have the waiver and supporting documents ready at the time of the IV interview.
