    Month-to-month lease eviction
    Hello,

    I have a question regarding real estate laws in Pennsylvania. If a tenant is on a month-to-month lease, and receives a 30 days notice to vacate the apartment, can the tenant stay if they have not found another place to live?

    I would sincerely appreciate any information.

    No you have to leave.
    Everybody that wanted to stay would be using no where else to go as an excuse.

    Is this an eviction notice from the landlord or from the magistrate?
    Pa only requires something like a 15 day notice from the landlord and then another 15 day notice from the magistrate so if you only got one 30 day notice your landlord was generous.

    If you pay up you should be allowed to stay IF that was the only reason for the eviction.

    As NoHelp said, landlords would never be able to get evictions.

    A lot, though, depends on the reason for the notice. It may be that the landlord can be flexible and willing to give more time, if the tenant has had trouble finding a place.

    But not being able to find a place will not stand up in housing court if the landlord pursues an eviction.
