Can my daughter at 16 emancipate herself from me? If so, what are the laws or things that must be for her to be able to do this? Can she do it without my permission if there is no abuse, neglect, etc. going on... she just wants to be on her own? We live in the state of Indiana.

It depends where you are from. Each country has different laws

She is going to have to show the Judge that she can support herself financially and that she can still go to school.

If there is no abuse, neglect, etc. though, I doubt very much she will get emancipated.

Emancipation is not like candy which is given out to every pissed off teenager out there.

Hello first that is what emancipation is, doing it without your permission,
That is why she would have to file with the court ( meaning she will have to hire an attorney at several thousand dollars to start with and pay court fees)

Next she will have to show she has a job earning enough money to pay for her living on her own. ( not just money to live with a boyfriend or other friend) she has earn enough to pay rent, electric, gas and so on.
Next she will have to show she can and will stay in school.

I had a boy that started talking that, I told him OK, he get a job and work and pay me rent just like a boarding house and I would save it back for him, and he would have to work full time and go to school and keep his grades up. I told him as he did this each month I would give him more and more freedom.

Guess what first he never found a job that paid enough to live on his own, but after working full time and going to school, he never had time or was too tired to ever do anything else. He soon figured dad paying the bills was not a bad idea

Without any extenuating circumstances, such as examples you've mentioned (abuse, neglect, etc.), probably not, unless she can demonstrate that she is capable of supporting herself financially, which at age 16 I doubt she can do. One exception would be if she has a child. Generally when a girl becomes a mother she's automatically emancipated.

I know this post is old . But just for those who do look and read . Emancipation laws are different of course in each state . But basically the child has to prove that he or she can live on their own . With no support from Mom or Dad . Stay in school , hold a job , pay all of own bills , and medical insurance . Now since most child labor laws stat they can only work so many hours . How are they supposed to pay ? For the kiddos reading this . Stay w/ your parents . Save your money and wait till you are 18 . You will wish you had once hit with the reality of the world outside ! I was a young mother . Having to decide what bill to pay with what little money I had . It's NOT fun .
