So here's the situation in short form. My daughters father and I split up 2 years ago and he moved out of state.he then got married,quit paying child support and I've since taken him to court for child support. Now he and his new wife are making a huge deal out of this and are threating to take my daughter from me. My daughter has many sever medical issues.im just wondering what can I do to make sure they don't take my daughter?and what are his rights as a father? Oh may I add we were never married!

Well since he has not visited or paid child support I doubt he will get custody, and since he does not live in the same school district I doubt he could get joint custody.

He could get a visitation order, you can fight and most likely he will have to do supervised visits to start.

And while back in court, you push for contemt for back child support.
