My wife has been working for a company for 9 months. As stated in her letter of offering, she agreed to a probationary period of 6 months, during which time she would not be able to take any time off from accrued vacation units. Also, the letter states that her performance would be evaluated at the end of the probationary period. A certain increase in pay (by %) would then be awarded at this time based on her score.

When her probation period ended 3 months ago, she began asking for her evaluation. After asking repeatedly, she was finally told a couple weeks ago that all employees' probationary periods were at least one year and that the company's recently instated spending freeze included any employee pay increases.

What recourse does she have at this point, if any?

Right now most companies are just trying to stay afloat. It is common knowledge that most companies are not giving raises due to the economy. If your wife wishes to keep her job, she'll just have to go along with what the company's current policies are for now or risk being let go. There are a lot of empty cubicles now in offices throughout the country. If she wishes to keep working at that particular firm, she should stop asking for her evaluation. She'll get it eventually or be shown the door. One or the other is enivitable.

She could push the issue, even sue for a percent increase, but she can be out of work also.

Most places I know are not giving any raises this year or last year, iin fact most are cutting wages about 25 percent.

So she is now off probation, she can show them the letter and see if she gets a good review or maybe a bad review,
