I got laid off last week and my previouse employer won't give me my last check. They are trying to tell me that money is missing and to replace it they are going to take my check. Please keep in mind that for the last 6 months my employee's and I have not been paid on time and our checks have been bouncing. I just wan't the money I'am owed so I can move on. What do I do?

After the pay period when you would normally get your check, if they don't pay, yes you can sue them in small claims or turn them over to the dept of labor

Depending on what your state's labor laws provide, there may also be substantial penalties (like double the amount) for failure to pay wages, particularly your final paycheck.

Contact the department of labor.
If you have any proof from other employees that you were always paid late ,etc. I would have that notarized to bring to them.
