    Tax Refund for F-1 students on OPT
    Hello,

    I am an F-1 visa student from Indonesia and I'm currently on my OPT. My friend once told me that I am qualified to get the full refund for both social security and medicare taxes that were deducted from my paycheck. He also just told me few hours ago that I am also qualified to get the refund for federal and the state taxes. Are these true?

    On F1/OPT you are exempt from residency for 5-years. You must file non-resident tax return Form 1040NR or 1040NR-EZ and Form 8843. Your income is not subject to SS tax and Medicare (FICA taxes) but you must pay federal and state income taxes. If your employer is withholding FICA taxes, then tell them not to withhold these tax and to refund you the taxes.

    On your OPT income you will get deduction based on tax treaty between the U.S. and your country, which is $2000.

    If your employer will not submit for the refund of the Social Security and Medicare taxes, get a refusal letter on company letterhead, then submit Forms 843 and 8316 (along with the letter and other support documents) to get the refund yourself.
