I was serverd a summons to appear in court for credit card debt. I don't have any assets and my only income is social security. What will happen if I don't appear?

If you don't show up, they will win everything they are asking for.

So they will get a judgement against you. Now they may not be able to collect but they will have the judgement

IF a judgement is ordered can they take my social security check?

If your cheque is deposited by Direct Deposit in your bank account along with other funds, yes, they can , but if you call now and have the cheque sent by mail, they cant. Simple.

Depends on who won the judgment. If I were to sue you, I wouldn't be able to take your SSI funds. However, SSI can be garnished for certain debts(back taxes, child support, etc.)

EDIT: I just read your initial question. If a default judgment is awarded against you for credit card debt, they cannot take your SSI funds if you have notified your bank where the funds are coming from. The creditor, however, can place the judgment on your credit report and, in certain states, place a lien against any personal property you have(your home, vehicle, etc.)

So I should call my bank and tell them that this account is strictly for my ss check. I have never made any deposits other than direct deposit for my ss check.

Yes tell them and see what they say.
SS checks are suppose to be exempt from most things.
(Not exempt from government or student loans)

No, you call your govt. facility and recind your order for direct deposit and have them mail your cheque to you. You have two options to receive your payments, that is one of them. Your bank has nothing to do with the transanction other then accepting it into your account electronically.

I was going to suggest that too but then it can be difficult to get it cashed through your bank.

Hi, nohelp, nothing is difficult through my bank, I use the ATM and on line banking. If I cash a cheque I sign the back of it, and put it through. Either put it in my account or keep the cash.

I lived in the states, did the same, unless something has changed I don't know about, everyone can do that if they have a bank account and their signature is on file with a bonefide bank account.
