    Hi There,

    I have been in the United states since 1998. I came on a F1 visa and got my BS degree in computer science and masters in Molecular Biology (Thesis defence pending). I am working in a research facility since 2006 and currently my status is H1-B. I would Like to apply for a green card for me and my spouse also in the US on H4 visa. My employer does not sponcer GC applications.

    Questions:
    What is the legal route I should take?

    Would my stay in the US legally for over 10 yrs be beneficial in any way?

    Without more information regarding your background, most H-1B's require a US petitioner to file the labor certification for employment-based immigration. You need to find a petitioner and file prior to the end of the 5th year of H-B to allow you to file extensions beyond the statutory 6 years of H eligibility.

    The 10 years in the US is irrelevant. Good luck.
