    What is the legal right of the father to his child if he's not married with the woman?

    Hello j:

    They're the same as if he were married. 50/50. But, to make sure that always HAPPENS, he needs to go to court to memorialize those write into a court order.

    As noted, marriage does not change the rights a father has to their biological child. But when married, those rights are conferred on the husband as father automatically. If unmarried, the father has to take positive action to get their rights. This means signing the birth certificate and/or an acknowledgement of paternity. It may also mean going to court to establish legal paternity, custody, visitation and support.
